Stanney Woods Avenue, Ellesmere Port
The public open space on this development comprises of fourteen areas of public open space including four ponds watercourses and woodland. The planning permission granted for the development in 1993 was subject to a Section 106 Agreement signed by the landowners, who are The Church Commission, the developers Barratt Homes and the Local Authority, then Ellesmere Port and it obliged the Council to adopt the open space areas on the payment of a commuted sum.
As part of a rationalisation of the local authorities, Ellesmere Port now falls under the administration of Cheshire West and Chester.
Whilst CW&C would be happy to honour their obligations under the terms of the historic Section 106 Agreement, if it was signed today the preference would be for the responsibility to be transferred to a suitable management company.
The long termed maintenance and enhancement of the open space has been secured by all parties agreeing to enter into a supplemental Section 106 Agreement, whereby the commuted sum would be paid to POSL by Barratt Homes and the Church Commission would transfer the freehold of the land to POSL.
CES Ecology part of the Cheshire Wildlife Trust have completed a survey of the existing ponds and given their recommendations to improve the quality and habitat value of the ponds.
